2.         Trademark, Copyrights and Intellectual Property
All text, graphics, images, logos, icons, software and other material found on the Website (the "Content") are the property of GorillaBlaster and are protected by U.S. copyright laws. GorillaBlaster authorizes you to view and download a single copy of the Content on the Website solely for your personal, noncommercial use.  You must retain all copyright, trademark, service mark, and other proprietary notices contained in the Content on any copy you make of the Content.  You may not reproduce, modify, display, sell, or distribute the Content, or use it in any other way for public or commercial purpose.

"GorillaBlaster" and the GorillaBlaster logo are service marks of Xodus Advantage, LLC.  In addition, the "look" and "feel" of the Website (including color combinations, shapes, layout, design and other graphical elements) are also protected by trademarks, service marks and copyrights. All other product and service marks contained on the Site are the trademarks of their respective owners. Any unauthorized use of the Content will violate copyright, trademark and other laws.

3.         Use of the Website
The Website and its offered Services are intended solely for individuals seeking employment.   The Website may be used only for acceptable and lawful purposes.   As one of the conditions of your use of the Website and offered Services, you represent, warrant and agree that you will not use (or plan, encourage or help others to use) the Website for any purpose or in any manner that is prohibited by these Terms or by applicable law.

All users are prohibited from violating or attempting to violate the security of the Website, including, without limitation: accessing data not intended for a user or logging into a server or account which the user is not authorized to access; attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization; attempting to interfere with service to any user, host or network, including, without limitation, via means of submitting a virus to the Website, overloading, "flooding", "mail bombing" or "crashing"; sending unsolicited e-mail, including promotions and/or advertising of products or services. The use of any device, software or routine to interfere or attempt to interfere with the proper working of the Website or the Services of GorillaBlaster, or taking any action which imposes an unreasonable or disproportionately large load on the Website's infrastructure is expressly prohibited.

By using the Website or the Services, you explicitly agree that:

you will not provide any Content or material or conduct yourself in any way that may be construed as: unlawful; illegal; threatening; harmful; abusive; harassing; defamatory; libelous; vulgar; obscene; pornographic; designed to interfere with or disrupt the operation of the Website or any of the offered Services; infected with a virus;  or that is in violation of an applicable local, national or international law;
(b) you will not impersonate or misrepresent your association with any person or entity; you will not forge or otherwise seek to conceal or misrepresent the origin of any material or Content provided by you;
(c) you will not collect or harvest any information about other users of the Services or Website;
(d) you will not provide, and you will not use the Website to provide, any material or service in any commercial manner, or in any manner that would involve junk mail, spam, chain letters, pyramid schemes, or any other form of unauthorized advertising or commerce.

4.         Passwords and Usernames
You are responsible for maintaining the confidentiality of your user account, username and password.  You shall be responsible for all uses of your user account and/or user name, whether or not authorized by you. You agree to immediately notify GorillaBlaster of any unauthorized use of your user account, information, username or password. 

5.         Relationship of Parties
GorillaBlaster's Services are designed to help match prospective employees with employers. You acknowledge and agree that employers and employees enter employment contracts directly with the each other. The Website is not a party to any contract between employers and employees, and is not involved in the contracting between employers and employees. By using the Services you acknowledge that you have engaged GorillaBlaster to act on your behalf, as your agent, to distribute, send, circulate and post your resume on various websites and web portals, and that such postings may be subject to the terms, conditions, rules and regulations governing each of these sites. 

To use GorillaBlaster’s Services, you must provide certain personal information (such as name, telephone number, and email address) and certain employment information (skills, training, work experience, employment history, and education). GorillaBlaster relies on you to provide truthful and accurate information and will not investigate your information and resume. GorillaBlaster assumes that information contained in your resume is truthful and accurate.

GorillaBlaster has arranged its information gathering systems to make the distribution of your resume to multiple web sites (which may require different formats). You authorize GorillaBlaster, using its judgment where necessary, modify your resume and personal information, if necessary, in order to meet the requirements of various web sites.

By using the Services of GorillaBlaster you are agreeing to these Terms and to the actions GorillaBlaster performs on your behalf and at your request, as if you had performed those actions yourself.  Your further acknowledge and agree that you will take full responsibility and are personally liable for any consequences arising from your use of the Website and Services.

6.         Disclaimer of Warranties
GorillaBlaster is not an employment agency or recruiting firm and makes no warranties or guarantees about any user's ability to procure employment or any other objectives of its users. 

GORILLABLASTER MAKES NO WARRANTY, EITHER IMPLIED OR EXPRESS, THAT ANY PART OF ITS  SERVICE AND THE OPERATION OF THIS WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, VIRUS-FREE, TIMELY, SECURE, ACCURATE, RELIABLE, OR OF ANY QUALITY, NOR IS IT WARRANTED EITHER IMPLICITLY OR EXPRESSLY THAT ANY MATERIAL FOUND ON THE WEBSITE IS SAFE IN ANY MANNER FOR DOWNLOAD.  NOR IS GORILLABLASTER RESPONSIBLE FOR ANY COSTOR EXPENSE IF YOUR USE OF THE WEBSITE OR ANY OF ITS CONTENT RESULTS IN THE NEED FOR SERVICING OR REPLACING EQUIPMENT OR DATA.

YOU UNDERSTAND AND AGREE THAT YOUR USE OF THIS WEBSITE AND OF ANY SERVICES OR CONTENT PROVIDED IS AT YOUR OWN RISK. 7.         Limitation of Liability
YOU EXPRESSLY UNDERSTAND AND AGREE THAT THE WEBSITE WILL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES; THIS INCLUDES, BUT IS NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA LOST EMPLOYMENT OPPORTUNITY OR OTHER INTANGIBLE LOSSES (EVEN IF THE WEBSITE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM THE USE OF SERVICES OR THE INABILITY TO USE SERVICES; THE COST OF OBTAINING SUBSTITUTE SERVICES RESULTING FROM ANY TRANSACTION ENTERED INTOTHROUGH SERVICES; UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR PERSONAL INFORMATION; STATEMENTS BY ANY THIRD PARTY OR CONDUCT OF ANY THIRD PARTY USING THE SERVICES; OR  ANY OTHER MATTER RELATING TO SERVICES OR ANY DOCUMENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

ANY CLAIM OR CAUSE OF ACTION BY YOU ARISING OUT OF OR RELATING TO THE WEBSITE, THE SERVICES, OR TERMS OF USE MUST BE INSTITUTED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION AROSE OR BE FOREVER WAIVED AND BARRED. ALL ACTIONS SHALL BE SUBJECT TO THE LIMITATIONS SET FORTH IN ABOVE.

BECAUSE SOME STATES OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU.   IF THIS EXCLUSION OR LIMITATION OF LIABILITY IS HELD INAPPLICABLE OR UNENFORCEABLE FOR ANY REASON, THE MAXIMUM OF GORILLABLASTER’S LIABILITY FOR ANY TYPE OF DAMAGES SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICES PROVIDED.

8.         Indemnity
You agree to indemnify and hold harmless GorillaBlaster and its representatives, affiliates, related parties, members, officers, directors, employees, and agents, from any claim or demand, including reasonable legal fees and costs, that may be filed by any third party, arising out of your conduct or connection and/or use of the Website or Services, your provision of personal information or other content, your violation of these Terms, or any other violation by you of the rights of another person or party.

9.         Governing Law, Jurisdiction and Venue
The Website, Services, and these Terms, shall be treated as though the Terms were executed and performed in Atlanta, Georgia and shall be governed by and construed in accordance with the laws of the State of Georgia without regard to its conflict of law principles.

10.       Arbitration
You agree that any dispute, of any nature whatsoever, between you and the GorillaBlaster arising out of or relating to the Website, the Services, or these Terms, shall be decided by neutral, binding arbitration in accordance with the Rules for Commercial Arbitration of the American Arbitration Association in Atlanta, Georgia.  A final judgment or award by the arbitrator may then be duly entered and recorded by the prevailing party in the appropriate court as final judgment. The arbitrator shall award costs (including, without limitation, the fees of the arbitrator and the American Arbitration Association, but not attorney’s fees) to the prevailing party.
